GENERAL NOTIFICATION

Wearing of Lifejackets and Personal Flotations Devices

1. Waterways Ireland wishes to remind all Masters of Vessels and water users of the requirements regarding Lifejackets and Personal Flotation Devices. Department of Transport, Tourism and Sport’s Marine Notice No 10 of 2016 states that:-

Lifejackets and Buoyancy Aids – Main Points
This Marine Notice is primarily addressed to pleasure and recreational craft owners, masters and users. It provides a brief summary of the legal requirements in relation to the wearing and carrying of lifejackets and buoyancy aids, the penalties arising from non-compliance, as well as advice on the selection and maintenance of Personal Flotation Devices.
The term “personal flotation device” (PFD) covers all forms of lifejackets and buoyancy aids which, when correctly worn and used in water, will provide buoyancy and increase the likelihood of survival. A lifejacket is designed to prevent drowning and must be capable of returning the user to the surface as quickly as possible and of keeping the person afloat, permitting breathing while waiting for help. Buoyancy aid clothing ensures a degree of buoyancy and support in the water while enabling the user to swim or take action to escape from danger.
Personal Flotation Devices and the Law – PFD Regulations
The Pleasure Craft (Personal Flotation Devices and Operation) (Safety) Regulations 2005 (S.I. No. 921 of 2005), as amended by the Pleasure Craft (Personal Flotation Devices and Operation) (Safety) (Amendment) Regulations 2012 (S.I. No. 349 of 2012), apply to pleasure craft being operated in Irish waters and to any person on board a pleasure craft or being towed by a pleasure craft, or on board a craft or object of any kind being towed by a pleasure craft.
There must be suitable PFDs for everyone on board any pleasure craft.

A suitable PFD must be worn at all times:

    • By anyone on board any moving pleasure craft (not tied up or made fast) that is under 7 metres in length, including personal watercraft (jet-skis);
    • By anyone under the age of 16 years on board any type of moving pleasure craft;
    • By anyone in another craft or on any other device (e.g. skis, donuts, etc.) being towed by a pleasure craft.

Except

    • Immediately prior to, during and after swimming from a stationary pleasure craft;
    • When putting on, wearing or taking off diving equipment on a stationary pleasure craft.

It is recommended that:

    • Anyone alone on board a pleasure craft should wear a PFD at all times regardless of weather conditions, the size of the pleasure craft or whether it is made fast or at anchor;
    • PFDs, if required to be carried, are stored in a readily accessible position;
    • PFDs should be fitted with hold-down devices such as crotch straps or thigh straps to maximise lifesaving potential and reduce the risk of the PFD riding up on the user;
    • Persons should wear lifejackets at all times while on open decked pleasure craft over 7 metres in length not fitted with inherent buoyancy.

Failure to comply with the legal requirements – Fixed Payments and Fines

Where an authorised officer has reasonable grounds for believing that a person is committing or has committed an offence under the PFD regulations, he or she may serve a fixed payment notice in the prescribed form on the person in question. The person who is alleged to have committed the offence may pay €150 during the period of 21 days from the date of the notice.
Failure to pay the €150 within the 21 days will lead to the institution of prosecution proceedings and, on summary conviction, to a fine not exceeding €5,000.

Selection and use of Personal Flotation Devices

Pleasure and recreational craft owners should select PFDs that are appropriate to:

    • the particular circumstances in which they will be used (e.g. area of operation, sea state, weather, ease of use);
    • the type of risks likely to be encountered (e.g. sudden immersion due to capsizing);
    • other factors (e.g. type and buoyancy of clothing worn, chemical exposure);

PFDs should be worn over all clothing and not underneath. PFD users should be familiar with the correct use and operation of their PFDs.

Servicing and maintenance of Personal Flotation Devices

Servicing of PFDs should only be carried out by manufacturers/approved agents in accordance with the manufacturer’s instructions, but users should still carry out regular safety checks prior to each use.

PFD users should not use PFDs with expired components and should remove PFDs from the boat and refer to an approved service agent if there are any concerns about a PFD.

Conformity Marking of Personal Flotation Devices

    • Every PFD made available on the European Union market should be CE marked.
    • Every survival lifejacket should be marked with the “ship’s wheel” mark.

2. Waterways Ireland encourages the safe use of its waterways by all. The wearing of Lifejackets and Personal Flotation Devices is an effective way of enhancing water safety.

Repairs to Railway Bridge

October & November 2018

Waterways Ireland wishes to advise all Masters of vessels and Users of the waterways that Coleraine Harbour Commissioners are carrying out repairs to the Railway Bridge from Saturday 6th October for six weeks. (Ref Coleraine Harbour Commissioners Local Notice to Mariners No 7/18)
Masters are requested to proceed with additional caution when passing though the railway bridge arches during the repair works.

Reparaturen an der Eisenbahnbrücke

Waterways Ireland möchte alle Kapitäne von Schiffen und Nutzer der Wasserstraßen darüber informieren, dass Coleraine Harbour Commissioners ab Samstag, den 6. Oktober, sechs Wochen lang Reparaturen an der Eisenbahnbrücke durchführen. (Ref. Coleraine Harbour Commissioners Local Notice to Mariners No 7/18)
Die Kapitäne werden gebeten, während der Reparaturarbeiten mit zusätzlicher Vorsicht vorzugehen, wenn sie die Eisenbahnbrückenbögen passieren.

Erne Pike Classic

Waterways Ireland wishes to advise masters and owners of vessels that the Erne Pike Classic fishing competition is being held on Lough Erne from Friday 12th October to Sunday 14th October. The bank competition will take place on Friday and the boat competition will take place on both Saturday and Sunday.
Henry Street and the outer length of mooring at the Round ‘O’ will be closed and will not be available for the mooring of vessels from Thursday 11th October to facilitate this event. Both Henry Street and the Round ‘O’ will become available for the mooring of vessels from Saturday morning.
Masters of powered craft are requested to be cautious and mindful of competitors on Lough Erne from Friday 12th October to Sunday 14th October.

ERNE PIKE CLASSIC
Waterways Ireland möchte die Kapitäne und Schiffseigner darauf hinweisen, dass der Erne Pike Classic Angelwettbewerb auf dem Lough Erne vom Freitag, den 12. Oktober bis Sonntag, den 14. Oktober stattfindet. Der Bankenwettbewerb findet am Freitag und der Bootswettbewerb am Samstag und Sonntag statt.
Die Henry Street und die äußere Länge des Liegeplatzes an der O-Runde werden geschlossen und stehen ab Donnerstag, den 11. Oktober, nicht mehr für das Anlegen von Schiffen zur Verfügung, um diese Veranstaltung zu erleichtern. Sowohl die Henry Street als auch die Round’O‘ werden ab Samstagmorgen für das Anlegen von Schiffen zur Verfügung stehen.
Die Kapitäne von Motorfahrzeugen werden gebeten, vom Freitag, den 12. Oktober bis Sonntag, den 14. Oktober, auf dem Lough Erne vorsichtig und achtsam gegenüber den Teilnehmern zu sein.

GRAND CANAL – 16th LOCK

Waterways Ireland wishes to advise all Masters of vessels that due to recent interference with racks on lock gates and to regulate water levels, padlocks have been installed on racks at the 16th Lock Grand Canal, Digby Bridge.
Access through the lock can be arranged through local Water Patroller 087-2895611 or by contacting Eastern Region Office at 01-8680148.

Waterways Ireland möchte alle Kapitäne von Schiffen darauf hinweisen, dass aufgrund der jüngsten Störungen von Racks an Schleusentoren und zur Regulierung des Wasserspiegels Vorhängeschlösser auf Racks am 16. Lock Grand Canal, Digby Bridge, installiert wurden.
Der Zugriff durch die Schleuse kann über die lokale Wasserpatrouille 087-2895611 oder über das Büro der Region Ost unter 01-8680148 erfolgen.

Permit Requirements for Mooring of Vessels and

Prohibition of discharge of Polluting matter (Holding Tanks)

Waterways Ireland wishes to advise all Masters of vessels that any owner wishing to use the canals (Royal, Grand and Barrow Navigation) is required to purchase an annual Combined Mooring & Passage Permit (CMP). This allows vessels on the canals and to moor for up to 5 days in any one location.
A CMP permit is adequate for short or infrequent visits to the navigations where a vessel is not moored for more than 5 days in a single location or will be removed from the navigation after each use. Additionally, if the vessel continuously cruises i.e. moves every 5 days, a Combined Mooring and Passage (CMP) permit will suffice.
Owners wishing to moor for a period in excess of 5 days in one location will require an Extended Mooring Permit (EMP).
An EMP provides a Waterways Ireland designated mooring location where the vessel may be moored for up to 12 months when it is not being used for cruising.
Owners are requested to familiarise themselves with the permit requirements before making an application.
Applications for Extended Mooring Permit (EMP) can only be made by owners who hold a Combined Mooring and Passage Permit (CMP). Both may be applied for simultaneously using the same form.
Waterways Ireland further wishes to further advise masters and owners of vessels that Article 38(l) of the Canals Act 1986, (Bye-Laws) 1988 states – “No person shall cause or permit any polluting matter to enter the canals, or deposit or cause to be deposited waste oil or any offensive matter on any part of the canal property”.

Genehmigungspflichten für das Anlegen von Schiffen und Verbot der Ableitung von Schadstoffen (Lagertanks)
Waterways Ireland möchte alle Kapitäne von Schiffen darauf hinweisen, dass jeder Eigentümer, der die Kanäle nutzen möchte (Royal, Grand und Barrow Navigation), verpflichtet ist, eine jährliche kombinierte Anker- und Durchfahrtsgenehmigung (Combined Mooring & Passage Permit, CMP) zu erwerben. Dadurch können Schiffe auf den Kanälen und bis zu 5 Tage an einem Ort anlegen.
Eine CMP-Genehmigung ist ausreichend für kurze oder seltene Besuche der Navigationen, bei denen ein Schiff nicht länger als 5 Tage an einem einzigen Ort festgemacht hat oder nach jedem Einsatz aus der Navigation entfernt wird. Wenn das Schiff kontinuierlich fährt, d.h. sich alle 5 Tage bewegt, genügt zusätzlich eine kombinierte Liege- und Durchfahrtsgenehmigung (Combined Mooring and Passage, CMP).
Eigentümer, die für einen Zeitraum von mehr als 5 Tagen an einem Standort anlegen möchten, benötigen eine erweiterte Anlegegenehmigung („Extended Mooring Permit“, EMP).
Ein EMP stellt einen von Waterways Ireland benannten Liegeplatz zur Verfügung, an dem das Schiff bis zu 12 Monate lang festgemacht werden kann, wenn es nicht für Fahrten genutzt wird.
Die Eigentümer werden gebeten, sich vor Antragstellung mit den Genehmigungspflichten vertraut zu machen.
Anträge auf eine erweiterte Verankerungsgenehmigung (EMP) können nur von Eigentümern gestellt werden, die im Besitz einer kombinierten Anker- und Durchgangsgenehmigung (CMP) sind. Beide können gleichzeitig mit dem gleichen Formular beantragt werden.
Waterways Ireland möchte die Kapitäne und Schiffseigner weiter darüber informieren, dass Artikel 38(l) des Canals Act 1986, (Bye-Laws) 1988 besagt: „Niemand darf verursachen oder zulassen, dass umweltschädliche Stoffe in die Kanäle gelangen, oder Altöl oder andere anstößige Stoffe auf irgendeinem Teil des Kanalvermögens deponieren oder deponieren lassen“.
Waterways Ireland dankt allen Schiffseignern und Betreibern für ihre Zusammenarbeit in dieser Angelegenheit.
